Argentine judge dismissed $LIBRA case against Milei and his sister, outlets report
Argentine outlets that say they saw the ruling report that the judge found the facts did not amount to a crime and that the decision can still be challenged; Le Coin has not seen the resolution.
Argentina's criminal case over $LIBRA, the token President Javier Milei promoted on X in February 2025, was dismissed for him, his sister Karina Milei and nine others on Friday, according to Argentine outlets that say they had access to the ruling [1][2]. Le Coin has not seen the resolution itself.
Federal judge Marcelo Martínez de Giorgi, of Federal Criminal and Correctional Court No. 8, issued the dismissal on Friday, Oct. 23, Perfil and La Nación reported [2][4]. Infobae and Perfil said he granted a request from prosecutor Eduardo Taiano [1][2]. Infobae reported that the ruling found the events "do not fit a legal offense" (Le Coin translation) [1]. Those dismissed include Hayden Davis, the token's creator, Infobae said [1].
Perfil and iProfesional reported that the 60-page resolution rests on article 336, section 3, of Argentina's federal criminal procedure code, which allows dismissal when the act investigated is not a crime [2][3]. According to iProfesional, the judge said Milei's post may have raised the project's profile and buyers' confidence, but that a criminally relevant deception, needed for fraud, was not proven [3].
Perfil reported that the ruling "can still be challenged" and that its reach is limited to the proceedings examined by that judge's court [2]. Infobae reported that the investors who had been accepted as plaintiffs were excluded from the case and that their complaints are pending before the Cámara Federal de Casación, Argentina's federal criminal appeals court [1]. iProfesional, citing reports, said the case would close if no plaintiff appeals [3]. None of the outlets gave a deadline. The dismissal is not an acquittal after trial; the accused were never called to testify as suspects, Infobae said [1].
Complainants had alleged that a few wallets pulled out about $100 million and that more than 40,000 buyers lost money, iProfesional reported [3]. Those are allegations. In a March 10 reply to the prosecutor, the presidency's general secretariat said it had no record of any confidential agreement between Milei and Davis, La Nación reported [4].
The next step to watch is the appeals court's decision on the pending appeals.
