Evening brief: Binance traces its attack to a fake job interview; voters go to the polls

Binance said a fake job interview opened the door to its Oct. 29 attack, a Cboe-backed group sued the CFTC over stock futures that never expire, and Americans voted in the midterms. Bitcoin closed the U.S. session at $77,789.97 on CoinGecko's 4:00 p.m. ET print.

Evening brief: Binance traces its attack to a fake job interview; voters go to the polls

Binance said its Oct. 29 attack began months earlier with a fake job interview and malware, and that it has set aside "more than 100% of the funds required to cover the loss." A group whose members include Cboe and Citadel Securities sued the CFTC over its approval of stock futures that never expire, and Americans voted in the midterm elections. [4][5][6]

What printed

01 · Binance traces its Oct. 29 attack to a fake job interview. In initial findings posted on its X account at 9:33 a.m. ET, Binance said the attack ran from a tampered software download in June and an "assignment" carrying malware, handed over in a fake job interview in September, to an internal AI tool and an Ethereum wallet permission feature on Oct. 29. Binance said about $6.34 billion in digital assets were affected, about $2.85 billion has been frozen or intercepted "subject to reconciliation and market price volatility," and "98% of the impacted token assets have been replenished" as of Oct. 31. Binance said, citing the FBI, that North Korea was responsible. [4]

02 · Cboe-backed group sues the CFTC over stock futures that never expire. Capital Markets Alliance Association, whose members include Cboe Global Markets, Citadel Securities and Healthy Markets Association according to Cboe, sued the CFTC and Chairman Michael S. Selig in the Southern District of New York (No. 1:26-cv-09608) in a complaint dated Nov. 3. It asks the court to "vacate and set aside" the approvals of applications by KalshiEX, Coinbase Derivatives and Bitnomial Exchange, to declare the contracts "security-based swaps," and to grant a temporary restraining order and injunctive relief. These are allegations in a complaint; the court has not ruled. Background: No-expiry single-stock futures can now trade on some U.S. exchanges. [5][6]

03 · Midterm ballots include crypto's Senate overseers. U.S. voters went to the polls Tuesday in the 2026 midterm elections, with all House seats and the Senate's Class II seats, whose terms end Jan. 3, 2027, on the ballot. Eight members of the Senate Banking Committee hold seats up this year: Republicans Mike Rounds, Thom Tillis, Bill Hagerty, Cynthia Lummis and Pete Ricketts, and Democrats Jack Reed, Mark Warner and Tina Smith. Nine members of the Senate Agriculture Committee also hold seats up this year. Fairshake, a crypto industry super PAC, reported $169.5 million in disbursements for the 2026 cycle and $19.4 million in independent expenditures, according to its FEC filings through Oct. 14; the figures cover that PAC only. Results were not official at publication. [7][8]

04 · SEC's transfer agent comment period closes. Comments on the SEC's proposed "Transfer Agent Rules," which cover the firms that keep companies' official shareholder records, close Nov. 3, according to the Federal Register notice published Sept. 4. [9]

05 · SEC staff: broad token-holder voting generally isn't a "central party." Staff of the SEC's Division of Corporation Finance added three crypto FAQs (1.4–1.6), each marked "added Nov. 2, 2026," saying participants in a broad-based governance system "generally will not be considered a 'group of persons or entities'" for purposes of the definition of "central party" if they are not affiliated and have no agreement "to act in concert (including through delegation)." Question 1.5 lists four powers that would mean a central party oversees participation, including authority to "reverse transactions, or revoke access." The page says the FAQs "are not a rule, regulation or statement of the Securities and Exchange Commission" and "have no legal force or effect." [10]

06 · Aave Labs, Kamino and Veda send the SEC a case that crypto lending isn't a security. The three companies published a 16-page public summary, dated Nov. 2, of a confidential paper they said they submitted on Oct. 26 to the SEC's Crypto Task Force and Division of Corporation Finance, asking to meet with staff. The paper argues that lending markets and non-custodial vaults create no note under Reves, no investment contract under Howey, and that the vaults "are not investment companies." It is an industry proposal; the SEC has published no response, and Aave Labs wrote that "the paper does not claim the SEC agrees with it." [11]

07 · Broadridge takes a $40 million hit on its crypto holdings. Broadridge said in an 8-K accepted at 8:10 a.m. ET (accession 0001383312-26-000030) that it booked a $40 million non-cash loss on digital assets in its fiscal first quarter, against a $46 million gain a year earlier, and held $185 million of Canton coins at Sept. 30. [12]

08 · BitGo's trust bank opens bitcoin rewards to custody clients. BitGo said at 11:57 a.m. ET that "eligible qualified custody clients can now earn BTC rewards on bitcoin that stays in BitGo Bank & Trust custody" through Stacks, a separate blockchain tied to bitcoin. It said the service "is currently limited to whitelisted institutional partners, managed by Stacks Labs," and that rewards "are variable, depend on protocol activity and conditions, and are not guaranteed." [13]

09 · Bullish picks Solana, Aptos and Ethereum for blockchain versions of company shares. Bullish (NYSE: BLSH) said it "named Solana, Aptos and Ethereum as the initial network partners for its equity tokenization services." It already uses Solana, where it transferred 61 million reserved Bullish shares at an Oct. 27 event at the New York Stock Exchange; it "plans to expand to Aptos and Ethereum" and gave no timeline for either. [14]

10 · Societe Generale will make markets in its own euro token on Kraken. Kraken said "EURCV trading is live as of Nov. 3, 2026." SG-FORGE said Societe Generale "will support EUR CoinVertible liquidity as market maker on Kraken, becoming one of the first major banks worldwide to perform this role in crypto markets." The release says the token will be used as collateral in Kraken's crypto derivatives "at a later stage," with no date. [15][16]

11 · Coinbase lists four more stock-linked perpetual futures. @CoinbaseAssets said at 9:03 a.m. ET that perpetual futures on BMNR, WDC, RKLB and AAOI "will go live on Monday, November 9, 2026… on or after 10:00 AM UTC," which is 5:00 a.m. ET. [17]

12 · Coinbase says New Jersey customers can again earn crypto rewards. Coinbase said in a post on X at 10:48 a.m. ET that staking is available again in New Jersey, citing rewards of "up to 12% APY," a yearly rate that includes compounding, which it said is "based on the estimated protocol rate, which is subject to change." Staking means locking up tokens to help run a blockchain in exchange for rewards paid by that network. Coinbase posted a New Jersey Bureau of Securities notice dated Oct. 30 stating that the bureau's 2023 order "is rescinded, without prejudice"; Le Coin has not found the notice on a New Jersey government site or a court record showing a related lawsuit was dismissed. [18]

13 · Texas Stock Exchange gets a standing rule for crypto funds. The SEC approved, on an accelerated basis, a Texas Stock Exchange rule letting it list commodity-based trust shares, including crypto funds, under generic listing standards without a separate SEC filing for each product, in an order dated Oct. 29 and published Tuesday. The rule lets up to 15% of a trust's net asset value be digital commodities or securities that don't otherwise meet eligibility criteria, and it covers "both passively and actively managed" trusts. The exchange joins Nasdaq, Cboe BZX, NYSE Arca and Nasdaq Texas; after Nasdaq, the order says, the SEC approved "substantially similar amendments for NYSE Arca and Cboe BZX and materially identical amendments for Nasdaq Texas." Unlike the Bitwise 10 notice, which covers one fund, this order approves the rule itself. The order states no effective date. [19]

14 · CME's crypto futures trading in October. CME Group said its cryptocurrency average daily volume, the number of contracts traded per day on average, was 145,000 contracts in October, or $7.85 billion notional, in its monthly volume release on Tuesday. Across all products, CME said average daily volume set an October record of 30 million contracts, up 15% from 26.3 million in October 2025. The release gives no year-over-year change for crypto. Separately, CME said in a post on X that October was its "strongest month to date for crypto weekend trading," at $1.3 billion in total volume, with "a record average daily volume of $340M, up 55% vs. September." [20]

15 · U.S. job openings little changed. "The number of job openings was little changed at 7.5 million in September," the Bureau of Labor Statistics said in its Job Openings and Labor Turnover Survey release on Tuesday, adding that quits "(3.4 million) increased." [21]

16 · Bhutan's Gelephu gets central bank powers, including crypto investment. Bhutan Broadcasting Service reported on Nov. 2 that the King signed a Royal Decree granting the Gelephu Financial Services Office "comprehensive central banking powers," and that the planned Gelephu Central Bank "will be empowered to invest in digital assets and cryptocurrencies alongside conventional reserve assets." No decree text, effective date or reserve size has been published. Public trackers disagree on the national government's bitcoin: ₿518 per BitcoinTreasuries.net as of Sept. 15, 2026, and ₿11,286 per Bitbo and ₿10,769 per CoinGecko, both checked 1:19 p.m. ET Nov. 3; none attributes any of it to the new bank. [22]

17 · Taiwan's FSC drafts stablecoin issuance rules. Taiwan's Financial Supervisory Commission said in a Nov. 3 release, in Le Coin's translation, that it has drafted stablecoin issuance and licensing rules under which nonbank issuers would need at least NT$300 million in paid-in capital, and stablecoins must be pegged one-to-one to the New Taiwan dollar or a single foreign currency, with reserves at fair value no lower than the amount outstanding. The drafts will be formally announced for comment, with comments accepted for 40 days from the day after the announcement, and would take effect with the Virtual Asset Service Act, whose effective date the Executive Yuan has not yet set. [23]

18 · Zcash's NU7 upgrade has an activation height, not a date. The Zcash Foundation's Zebra v7.0.0 release notes say the NU7 network upgrade activates on mainnet at block height 3,543,405. The notes give no date or time, and the activation date is unconfirmed. [24]

19 · Other comment deadlines this week. Federal Register comment periods close on FinCEN's proposed special measure on the A7 network, whose text covers the A7A5 stablecoin and the sanctioned exchanges Garantex and Grinex (Nov. 4); a CFTC information collection (Nov. 5); a Treasury Privacy Act notice (Nov. 6); and the SEC's "Political Contributions by Certain Investment Advisers" (Nov. 9).
